By accessing and using SafeCart's services, including our website, Chrome extension, and business dashboard (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

SafeCart provides product safety monitoring and compliance services, including: • Chrome extension for consumer product safety alerts • Business dashboard for product safety compliance monitoring • Automated monitoring against the EU Safety Gate database • Product safety notifications and alerts • GPSR compliance tools, including product labels and product safety passports • Integration with WooCommerce and other connected stores

To access certain features of our Services, you may need to create an account. You are responsible for: • Providing accurate and complete information during registration • Maintaining the security of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorized use of your account

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not: • Use the Services for any illegal or unauthorized purpose • Attempt to gain unauthorized access to our systems • Interfere with or disrupt the Services or servers • Upload or transmit viruses or malicious code • Violate any applicable laws or regulations

SafeCart provides product safety information sourced from official databases, including the EU Safety Gate. While we strive for accuracy: • Information is provided "as is" without warranties • Users should verify critical safety information independently • SafeCart is not liable for decisions made based on our information • Safety alerts are based on publicly available data

For business users, additional terms apply: • We offer Free and Pro plans. Pro costs €29/month and is billed in advance through our payment provider, Stripe. • Paid subscriptions renew automatically for successive billing periods until cancelled. • You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. • Business accounts may have usage limits based on subscription tier (for example, the number of monitored products). • API access is subject to rate limiting and fair use policies. • Where SafeCart processes personal data on your behalf, our Data Processing Agreement (DPA) applies in addition to these Terms. • Business data is processed according to our Privacy Policy.

SafeCart and its licensors own all rights to the Services, including: • Software, technology, and algorithms • Trademarks, logos, and brand elements • Content, design, and user interface • Data compilations and analysis tools Users retain rights to their own data and content submitted to the Services.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of information as described in our Privacy Policy.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW: • We disclaim all warranties, express or implied • We are not liable for indirect, incidental, or consequential damages • Our total liability is limited to the amount paid for Services in the past 12 months • We do not guarantee uninterrupted or error-free service

You agree to indemnify and hold SafeCart harmless from any claims, damages, or expenses arising from: • Your use of the Services • Your violation of these Terms • Your violation of any third-party rights • Any content you submit through the Services

We may terminate or suspend your access to the Services at any time, with or without cause or notice. Upon termination: • Your right to use the Services ceases immediately • We may delete your account and data • Provisions that should survive termination will remain in effect

We reserve the right to modify these Terms at any time. We will notify users of material changes by: • Posting updated Terms on our website • Sending email notifications to registered users • Displaying notices in our Services Continued use of Services after changes constitutes acceptance of new Terms.

These Terms are governed by the laws of Belgium and the European Union. Any disputes will be resolved in the courts of Brussels, Belgium. For consumers, this does not limit any mandatory consumer protection rights under local law.
